Announcing that the new SGA level will go up from $1,010 to $1,040 per month effective January 1, 2013. Counties unable to implement this change by January 1, 2013 must retroactively redetermine Medi-Cal eligibility based on disability if a case has been denied erroneously.
Applicants who have average monthly earnings at the SGA level cannot be considered disabled even if severe physical or mental medical impairments exist, unless 1) legally blind individuals and who meet the federal Supplemental Security Income criteria, 2) Medi-Cal beneficiaries who return to work after disability has been approved, or 3) to persons applying for Medi-Cal under the 250 Percent Working Disabled Program.
