HUD 74 FR No. 166, p. 44285 – Refinement of Income and Rent Determination Requirements in Public and Assisted Housing Programs; Delay of Effective Date (8/25/09)

This action relates to the final rule revising HUD’s public and assisted housing program regulations to require that PHAs and owners of assisted housing use HUD’s Enterprise Income Verification (EIV) system. The rule was to go into effect on September 30, 2009, after a prior delay. Now the effective date has been postponed once again to January 31, 2010. There was significant public comment on the final rule raising concerns about applicants’ and participants’ ability to obtain identifying documents required under EIV such as birth certificates and children’s social security numbers. The delay will give newly confirmed HUD officials an opportunity to review and consider these comments. [Download.]

PIH Notice 2009-22 – Over Subsidization in the Housing Choice Voucher Program (7/21/09)

This notice renews much of last year’s notice on the same subject, including the restrictions on approval of an extra bedroom for family caregivers and rotating caregivers. The notice includes a specific provision for seeking reasonable accommodation, a mechanism that advocates might use to seek exception such restrictions. [Download.]

ACWDL 09-42: Medi-Cal Referrals and BCCTP –County Responsibilities (9/15/09)

Counties are responsible for referring Medi-Cal applicants and beneficiaries with breast cancer to BBCTP. If an applicant or beneficiary may be disabled she should be referred for a disability determination as well as referred to BCCTP. Beneficiaries losing Medi-Cal eligibility should not be cut off until a determination has been made by BCCTP. ACL 09-42: TANF Emergency Contingency Fund: Subsidized Employment (9/15/09)

Program instructions for implementing the expansion of CalWORKs subsidized employment programs through the TANF Emergency Contingency Fund (ECF). Counties can expand subsidized employment programs now, but access to TANF ECF funds for county programs is contingent upon federal approval, and counties would be on the hook if denied. The letter also provides instructions re: providing such positions to low-income needy families who have not previously been eligible for TANF. (Guidance for implementing new expanded basic assistance and nonrecurring short-term benefits under TANF ECF will be released under a separate All County Letter.)

States may be reimbursed up to 80 percent of increased TANF/TANF MOE spending in FFY 2009 and FFY 2010 on any of the following three categories:
1. Increased basic assistance expenditures, as long as there is an increased caseload
2. Increased expenditures for subsidized employment
3. Increased expenditures for non-recurring short-term benefits.

All expenditures related to operating a subsidized employment program, including the cost of overseeing the program, developing work sites, and providing training to participants, may be claimed. Includes a list of eligible populations. [Download]
