ACIN I-17-07: CalWORKs: Retroactive $50 Child Support Disregard (4/6/07)

In the “Better late than never,” category, CDSS announces that it this past February, the Department  of Child Support Services (DCSS) sent out retroactive $50 child support disregards, to compensate for the failure to timely credit and issue payments in the transition between Local Child Support Agencies and DCSS.  A reminder that the retroactive payments (as well as the regular ones) are disregarded as income for both CalWORKs and Food Stamps.  And, as an added bonus, recipients “shall not be discontinued for failure to report” the retro payment, presumably a reference to accepting a QR 7 as complete whether or not the retro payment is reported.   [Download]

ACIN I-11-07: Supplemental Forms and Food Stamp/CalWORKs (3/27/07)

A rose by any other name would smell as sweet, but never a Pre-screening and Supplemental form shall meet. This ACIN discusses the difference between a Pre-Screening form (prohibited if asking eligibility questions prior to application ) and a Supplemental form (fine and dandy if “gathering information needed to begin an interactive interview after the application is signed”).  It’s also fine to get information unrelated to the application/eligibility for purposes of referrals to other offices/programs. ACL 07-13 KINGAP Program Enhancements (3/13/07)

In 2006, the legislature created “KinGAP Plus,” but gave CDSS the option to suspend KinGAP Plus if it were determined that implementation would not be advantageous to the state. Well, that came true, so KinGAP Plus is suspended. In the event that this happened, the statute gave CDSS the authority to implement alternative “enhanced benefits” in the existing KinGAP Program. So, this is where we are now: an ACL implementing these enhancement, effective retroactively to October 1, 2006.

The new program enhancements are: coverage of probation youth in foster care but under the supervision of the juvenile delinquency court. (See the ACL for eligibility requirements); the payment of Specialized Care rates if the child got these payments through Foster Care in the month prior to changing to KinGAP; all KinGAP recipients are now entitled to the $100 annual state supplemental clothing allowance, but other clothing allowances under the county foster care payment structure. All Kin-Gap recipients, as well as all relatives of children in permanency planning where guardianship may be recommended, will be notified by mail of the changes.

Because of the complexity in tracking down information on special needs payments prior to transitioning to KinGap, CDSS has given counties “latitude” to taken longer to make the determination of eligibility for these payments. Counties “should make every effort to determine eligibility for the [specialized care] as soon as possible but no later than a child’s next annual redetermination or the end of the state fiscal year, June 30, 2007 whichever is earlier.”  There is no provision for new specialized care determination, or adjustments to the rates – people get whatever was paid through foster care.  Regulations on this whole packet are in development. ACIN I-05-07: New In-Home Supportive Services (IHSS) Plus Waiver Program Regulations (2/23/07)

The “new” regs, effective 10/1/06, are attached to this ACIN.  Basically, the IHSS Plus Waiver regulations replicate the “IHSS-R” Program regulations…except where they don’t. This ACIN lists the differences. Some variations in eligibility, program content, application process, needs assessment and overpayment process. Do IHSS? check out the details…. [Download]

ACL 07-03: Federal Reauthorization Of TANF (1/12/07)

For the less welfare-nerdy (see ACL 07-05), a summary of the major changes to TANF in light of the federal Deficit Reduction Act and the federal Interim regulations, and California’s response to these changes. And yeah for our clients, this letter also clarifies that despite the changes that have been made to the TANF program at the federal level, the structure of CalWORKs welfare-to-work has not changed.  CalWORKs continues to require counties to offer a broad range of employment and education activities, behavioral health services, and other activities necessary to help recipients achieve self-sufficiency.
