ACL 01-10: CalWORKs and Food Stamps Program Whereabouts Unknown and Client EBT Usage (1/29/10)

Guidance to CWDs on how to handle cases when the whereabouts of an AU/household is unknown, because of returned mail, etc.  Of note, for CalWORKs, residence in the state, but not in the county, is a requirement for continued eligibility for aid, and so AUs may not be automatically discontinued for “whereabouts unknown.” The worker must attempt to contact the AU and give them an opportunity to clarify the discrepancies, send an incomplete QR 7 notice, and make a Balderas contact before terminating aid, as well as before any referral for a fraud investigation.

For Food Stamps, CWDs cannot terminate for “whereabouts unknown,” but only for loss of residency, based on “reliable information.” When residency is questioned because of EBT usage, workers must attempt to contact the recipient for clarification, prior to any fraud referral. The letter reviews why recipients may be using EBT cards outside their home county, and why this is permissible if it does not involve a change in residency. ACL 01-10: CMSP eligibility manual update (3/11/10)

This letter details several changes to the CMSP eligibility manual that went into effect 4/1/10:
• Conforms the CMSP definition of long term care with the Medi-Cal definition.
• Removes GA/ GR from the same category as other public assistance programs- now those who receive GA/ GR are not excluded from the budget unit.
• Makes failure to cooperate with SSA a reason for denial or discontinuance. This denial is rescinded if an appeal is made to SSA within 30 days.
• Social Security overpayment reductions will be excluded in income/ share of cost calculations.

ACIN I-85-08: County Children’s Trust Fund Share Of Kids’ Plate Revenue (11/14/08)

Notice that the state is doing its own economic stimulus package: within the next 90 days it will distribute Kids’ Plate revenue (from the DMV sale kids license plates). The total revenue for SFY 2007-2008 is $1,264,000. Each county’s share is based on their proportion of the State’s children’s population age 0-18. The funds must be distributed as follows: • 50% to the Child Day Care Licensing Unit of the DSS Community Care Licensing Division; 25% to the DHS Childhood Injury Control Program within the California Department of Health Services; 22.5% to County Children’s Trust Funds; and 2.5% to the State’s Children’s Trust Fund. ACL 08-22E: Correction – Transitional Food Stamp/Household Member Is Approved For Benefits In Another Food Stamp Household (8/6/08)

Some wrong cites, and clarification regarding the treatment of any deductions allowed in the Transitional Food Stamp (TFS) when an individual leaves the TFS household because he/she has been approved in a different household. CWDs must also disallow any deductions attributable to the person who left (as well as income), when the individual is aided in another household. [Download]
