Effective December 26, 2007, eligible Iraqi and Afghan special immigrants (SIs) are entitled to time limited refugee medical assistance (RMA). Iraqi SIs have 8 months of eligibility for RMA, Afghani SIs have 6 months of eligibility. Eligibility begins to run either from the date of arrival in the US if SI status was attained outside the US, or from the date of grant of LPR status if status was adjusted to SI in the states. The U.S. Citizenship and Immigration Services has published an interim final rule that allows “T” and “U” non-immigrants to adjust to lawful permanent residence. Written comments on the rule are due by February 10, 2009.
This interim rule conforms HUD’s regulations to the self-implementing Violence Against Women Act’s (VAWA) provisions for families applying for or receiving rental assistance under HUD’s public housing and tenant- and project-based Section 8 programs.
