ACIN I-05-08: Food Stamp Q&As (2/1/08)

Those Food Stamp people never stop! Yet another Q & A. The highlights? Restricted CalWORKs accounts’ impact on food stamps; treatment of child support arrearages; shelter costs when SSI recipient in household; impact of full-time post-60 CalWORKs months student on food stamps; BOGG student grants as exempt income; notice of missed interviews for recert.  Regs@ favorite? Can the county make a recipient go to court to recoup an IRS intercept fee, when the county erroneously sent the case to the IRS, and owes the claimant the recouped issuance. (Truth and Justice prevails in the answer.) Sadly, the Q & A also clarifies that the county need not investigated parole/probation violations if there is an outstanding warrant for these issues. ACWDL 08-04: CONFIDENTIALITY POLICIES GOVERNING MEDI-CAL AND THE MEDI-CAL ELIGIBILITY DATA SYSTEM

Medi-Cal beneficiaries information is now confidential; it can only be released for purposes directly related to administration of the Medi-Cal program. Employees can only access as much beneficiary information as they need to administer the program. As of 2/1/08 most providers will not get paid unless they bill using the beneficiaries BIC number, as opposed to the SSN. Beneficiaries have been noticed that providers can refuse to give them medical care if they do not have their BIC with them at appointments. [Download]

ACIN I-07-08: ABAWD Waiver For 2008-2009 (2/4/08)

That time of year again, for counties to “opt out” of helping more low-income folk eat. The waiver of the ABAWD work requirement will occur, lasting from May 1, 2008 through April, 2009, unless a county declines to participate. Counties wishing to “decline” the waiver must send a letter from their Boards of Supervisors by March 15th. The ACIN lists the fifty-two northern and central California counties which qualify for a waiver. Followed by lots of reminders of the rules. The remaining six counties can qualify using the 15 percent ABAWD exemption, to grant food stamps for additional months to ABAWDs who have used their three out of 36-months and whose circumstances make it difficult to satisfy the work requirement. Counties are given the flexibility to set criteria used in granting the 15 percent exemption. (The ACIN lists such things as illiteracy, living in remote areas, an inability to speak, read, or write English, seasonal employment, social and emotional barriers, and temporary employment of less than 20 hours per week.)

ACWDL 08-03- Notices of Action for the Requirement to Provide Evidence of Citizenship/ National Status and Identity as a Condition of Medi-Cal Eligibility (1/24/08)

This ACWDL contains 5 different DRA related NOAs, in English and Spanish. They have yet to be translated into other threshold languages. The first two NOAs inform Medi-Cal applicants that they have been approved for restricted-scope Medi-Cal with or without a share of cost for failure to provide acceptable evidence of citizenship/ national status or identity. Notice’s 3 and 4 inform beneficiaries that their benefits are being reduced for not providing acceptable evidence. The final notice restores full-scope benefits to both applicants and beneficiaries because acceptable evidence was provided- yay. [Download]

ACWDL 08-01- Integration of County Performance Standards Application Samples (1/18/08)

Previously the Program Review Section reviewed Counties’ application processing times using two different application samples, one for general applications and one for disability-based applications. This ACWDL changes the process and integrates the area of application processing into one application sample. The idea is that the new process will create samples that are more representative of the total application population; the old process was yielding low numbers of reviewable disability- based cases. The reviews will be based on the same time standards of 45 days for general applications and 90 days for disability-based applications; of course disability-based applications that cannot be processed within 90 days due to state agency delay will not be considered.   [Download]
